1. Introduction & Acceptance of Terms
1.1 Overview
Welcome to RyTech LLC (“RyTech,” “we,” “us,” or “our”). By placing an order, using our website, or engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must discontinue using our products and services.
1.2 Modifications
We reserve the right to modify or update these Terms at any time. Any changes will be posted on our website (and/or communicated via email), and the Effective Date at the top will be updated accordingly. Your continued use of our services or products after changes are posted will constitute acceptance of those changes.
2. Order Process & Pricing
2.1 Order Placement
- Orders can be placed through our website, by phone, or via any authorized sales channel.
- Any price quotations provided (e.g., online, email, promotional materials) are valid at the time they are issued and may be subject to change before your order is finalized.
2.2 Pricing & Payment Terms
- Payment Methods: We currently accept PayPal, Stripe, and credit cards. Payment is due in full unless otherwise agreed in writing.
- Price Changes: All listed prices are subject to change without prior notice. In the event of a pricing error, we reserve the right to cancel or refuse an order.
- Late Payment Fees: Past-due balances may incur a late fee or interest as permitted by applicable law.
2.3 Order Confirmation
After placing your order and upon successful payment, we will provide a confirmation. This confirmation does not guarantee availability of all components. If any part is unavailable, we will contact you to discuss alternatives.
3. Product Specifications & Availability
3.1 Configuration & Part Substitutions
RyTech may substitute components of equal or greater performance/value when an original part becomes unavailable. We will make reasonable efforts to notify you of any significant changes that could affect performance.
3.2 Accuracy of Product Descriptions
We strive for accuracy in our product descriptions and specifications. However, typographical errors or other inaccuracies may occur. We reserve the right to correct such errors and update product information without prior notice.
3.3 Availability
All products are subject to availability. If an item is out of stock or discontinued, we will notify you and provide options for an alternative or a refund.
4. Shipping, Delivery & Risk of Loss
4.1 Shipping Methods & Coverage
- We currently ship only within the United States.
- The choice of carrier (e.g., UPS, FedEx, USPS) will be decided by RyTech at the time of shipping.
- Once a shipping label is printed, we will provide updated tracking information (e.g., tracking number).
4.2 Delivery Delays
We are not responsible for delays caused by events outside our control, including natural disasters, carrier delays, or other unforeseen circumstances. We will notify you of any significant shipping or delivery issues as soon as possible.
4.3 Transfer of Risk
Risk of loss or damage to products passes to you upon delivery by the carrier. If a shipment arrives damaged, please contact both us and the carrier immediately to initiate a claim.
5. Returns, Exchanges & Refunds
5.1 Return Period
You may request a return or exchange within 14 days of the delivery date.
5.2 Return Conditions
- Products must be returned in their original packaging, with all accessories and documentation if possible.
- If a device has been opened or tampered with, it is ineligible for return. This measure protects RyTech from returns of devices that may be damaged, modified, or missing components.
- You are responsible for return shipping costs unless the return is due to our error.
- A restocking fee may apply if items are not returned in “like new” condition.
5.3 RMA Process
Before returning any item, you must obtain a Return Merchandise Authorization (RMA) number from our support team. Returns without an RMA may be refused or delayed.
5.4 Refunds
Refunds will be processed within [e.g., 5–10 business days] after receipt and inspection of the returned item. Original shipping costs may be non-refundable, depending on the reason for the return.
6. Product Warranty & Support
6.1 Standard 1-Year Warranty
- RyTech provides a 1-year warranty covering parts, shipping, and labor if a fault is found to be on the part of RyTech LLC (i.e., a defect in materials or workmanship).
- The warranty period begins on the original purchase date.
6.2 Void Conditions
If a device is tampered with or modified in any way during the 1-year coverage, the warranty for that device is void.
6.3 Warranty Claims
- To file a warranty claim, contact our support team. You may be required to ship the product to a designated service center.
- Warranty coverage does not include data recovery, software issues, or problems caused by user misuse or negligence.
7. Limitation of Liability
7.1 Indirect or Consequential Damages
To the fullest extent permitted by law, RyTech is not liable for any indirect, incidental, consequential, or special damages, including but not limited to lost profits, lost data, or loss of business opportunity.
7.2 Liability Cap
Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount you paid for the product or service at issue.
8. Software & Licensing
8.1 Bundled Software
Any operating system or application software pre-installed on a device is licensed to you, subject to the End User License Agreement (EULA) from the software developer.
8.2 Intellectual Property
All trademarks, software, and other intellectual property remain the property of their respective owners. You may not modify or distribute any software, except as permitted under the applicable EULA.
9. Customer Responsibilities
9.1 Proper Use
You agree to follow recommended guidelines for operating your device, including ensuring adequate ventilation and avoiding misuse (e.g., overvolting, unauthorized repairs, overclocking).
9.2 Data Backups
You are responsible for backing up your data. RyTech is not liable for any data loss or corruption. Before sending a product for service, ensure all essential data is backed up or removed.
10. Privacy & Data Protection
10.1 Data Collection
We collect personal information (e.g., name, address, payment details) necessary to process orders, provide customer support, and improve our services.
10.2 Security Measures
We use industry-standard security measures to protect your personal information. However, no system is entirely foolproof; by using our services, you acknowledge the inherent risks of online data transmission.
11. Dispute Resolution & Governing Law
11.1 Governing Law
These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
11.2 Jurisdiction
You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in Arlington County, Virginia. You hereby consent to the jurisdiction of such courts and waive any objection to venue in them.
12. Termination or Cancellation
12.1 Customer Cancellation
You may cancel your order before it moves into final assembly or shipment. If the order is in production, a cancellation fee may apply.
12.2 RyTech LLC Cancellation
We reserve the right to cancel any order if we suspect fraud, significant pricing errors, or if fulfilling the order becomes unfeasible. In such cases, you will be notified promptly and refunded any payments made.
13. Updates to Terms
13.1 Policy Changes
RyTech may revise these Terms at any time by posting updated Terms on our website. Your continued use of our products and services after such posting indicates your acceptance of the changes.
13.2 Notification
We may notify customers of significant changes via email or a prominent notice on our website prior to the change becoming effective.
